Is CBD Oil Legal In My Country?

Everyone wants to know whether it’s legal in their countries, so I’m gonna talk about that in a second. First of all, you need to know that CBD oil can come from both the hemp plant and from marijuana.  Both of those plants are different varieties of cannabis but they’re much different in terms of chemical compounds they have. Medical marijuana is good for people with certain ailments because it does contain THC and any varying level of CBD. The level of THC is one of the factors that determines the legality of CBD in different countries.

The CBD products that we sell are made from industrial hemp which only contains the component CBD and contain a minimal amount of THC (0.3%) The products on our website are legal throughout the United States in all 50 states. 

Hemp oil is legal to be imported, to be used and be sold.  Typically, it’s used for things like paper, clothing, different types of textiles and we have a CO2 extraction process that we use to extract the CBD oil from the hemp plant and because it’s made from hemp and not medical marijuana, again, it has very, very low levels of THC.  This is why it is a dietary supplement in the United States.

So if you’re living in the United States, it’s very clear that our products, all the CBD oil from hemp plants, they are considered 100% legal and they are considered a dietary supplement by the FDA.  That means it’s legal to ship and consume throughout all 50 states within the US.

If you’re outside the United States, things get a little more tricky because not every country has explicitly stated the legalities on these types of oils. 

Canada

In Canada, cannabis is federally legalized as per the Cannabis Act, though it comes with some strict provisions and regulations. While allowing adults access to cannabis, the Cannabis Act aims to keep cannabis out of the hands of minors and prevent criminals from profiting off of cannabis sales. Adults 18 and older are allowed to possess up to 30 grams of cannabis in public. They may also share up to 30 grams of legal cannabis with other adults. Adults can also purchase cannabis products, including oil, from any provincially licensed retailer. In Canadian provinces or territories that do not have a regulated framework, adults may purchase cannabis from any federally licensed cannabis producers online.

Australia

In 2017, state and federal health ministers in Australia legalized industrial hemp and hemp products for human consumption. This comes after years of proposed amendments starting in 2002. 

However, the legalization of industrial hemp in Australia comes with restrictions. Similar to laws in the United States, industrial hemp is identified as having THC concentration no higher than 0.1-0.3 percent, depending on the state. Labels on hemp-based foods and products cannot allude to any psychoactive effects or refer to “marijuana” or “cannabis”.

Furthermore, access to CBD products in Australia is restricted. Not only do you need a prescription to legally purchase and use CBD, but the doctor prescribing that CBD must also have been granted a Special Access Scheme Approval or be a designated Authorized Prescriber.

Access to CBD oil products in Australia is limited, which is why many purchase products from the United States and other overseas markets.

United Kingdom

In the United Kingdom, cannabis is considered a controlled substance as classified by the Misuse of Drugs Act 1971. The Misuse of Drugs Regulations Act of 2001 later categorized cannabis as a schedule I drug. However, CBD is not included in the list of cannabinoids considered as controlled substances under either act. This makes CBD legal, albeit with some restrictions;

• CBD can only come from industrial hemp strains that have been approved by the EU. 
• CBD oil can contain no more than 0.02 percent THC, and the THC must not be easily separated from the oil.

In 2016, the MHRA stated that CBD oil that is advertised for any medical purpose must be licensed. However, CBD products can still be sold without a license as long as the product does not make any specific medical claims. 

If you live outside the United States, we generally recommend that you look into your Customs Department and ask them if you are able to import CBD products from the United States, and we can ship it worldwide. The only problem is that we don’t always know if it’s going to be received on your end.
