Ohio has had a somewhat liberal relationship with cannabis, becoming only the sixth state to decriminalize it, way back in 1975. However, measures to fully legalize recreational cannabis use have stalled, most recently in 2015.
The state then became the 28th overall to legalize medicinal marijuana when House Bill 523 was signed into law by Governor John Kasich in 2016. And yet, this bill meant that CBD oil could only be sold in state-licensed medical marijuana dispensaries.
That changed three years later, when Governor Mike DeWine signed Ohio’s hemp legalization bill (Senate Bill 57) into law, effectively allowing hemp products, including CBD oil, to be freed of embargoes and sold by retail businesses in the state.

Senate Bill 57 lays out, in no uncertain terms, the difference between hemp, hemp products, and marijuana. It essentially states that to be considered a hemp product, it must not exceed a THC concentration of 0.3%.
This brings Ohio in line with many other US states (and countries worldwide) where hemp-derived CBD oil is now legal.
Ohio’s Possession Laws
While CBD oil products are now legal in Ohio, recreational marijuana use remains illegal. Possession of up to 100 grams of marijuana is considered a minor misdemeanor and carries a maximum fine of $150. Possession of more than 100 grams – but less than 200 grams – of marijuana is a misdemeanor punishable by up to thirty days in jail and a $250 fine.
Is CBD hemp oil legal in Ohio?
