You see, CBD oil is legal to buy in Canada, but it’s also highly regulated and its availability is restricted.

Is CBD Oil legal in Canada?

  • LEGAL – Low-THC CBD oil is legal to buy in Canada with a valid prescription.
  • LEGAL – Medical cannabis is legal in Canada with a valid prescription.
  • LEGAL – Recreational cannabis is legal in Canada.

Under the Cannabis Act (2018), CBD is considered a controlled substance, and CBD products are strictly regulated and only legal when sold in compliance with the Act. This includes CBD derived from hemp.

This means that Canadian citizens over the age of 18 can only legally purchase CBD oil if:

  • They’re registered medical patients with a valid prescription from their healthcare provider; and
  • They’re purchasing the CBD oil from a Licensed Producer.

These rules also prohibit bringing CBD products into the country. For instance, you cannot buy CBD oil in the US and cross the border back into Canada with it, nor can you import CBD via an online retailer. It must be purchased from a Licensed Producer in Canada, and only with a valid prescription.

Canada’s Possession Laws

Following the introduction of the Cannabis Act in 2018, Canada became only the second nation (after Uruguay) to fully legalize marijuana. This meant that individuals aged 18 and over could legally possess up to 30 grams of cannabis.

Sanctions for possessing over the maximum amount vary depending on the situation, from warnings and tickets for minor offenses to criminal prosecution and jail time for more serious indiscretions.
